These Terms of Service ("Terms") govern your access to and use of sparkroadai.com and the products and services provided by Spark Road AI, a division of EMH Stores LLC ("Spark Road AI," "we," "us," or "our"). By using our site, chatting with us, booking a call, requesting a demo, or purchasing a service, you agree to these Terms. You must be at least 18 years old and have authority to enter into these Terms on behalf of yourself or the business you represent. If you do not agree, do not use the site or services.
We build and operate done-for-you AI chat and voice systems for local service businesses, including website chat bots, scheduling assistants, and AI voice systems. The specific features, scope, and pricing of any service are described to you before purchase. We may modify, add, or discontinue features over time. We aim to deliver quickly — most systems go live within a few business days of receiving what we need from you — but we do not promise a specific delivery date or specific business results.
Our services are offered as monthly subscriptions (for example, $79, $149, or $497 per month depending on the plan), some of which include a one-time setup fee disclosed before purchase. Subscriptions are billed in advance on a recurring basis to the payment method you provide and renew automatically until cancelled. Payments are processed by our third-party processor (Stripe) through our CRM (GoHighLevel); we do not store full card details. You are responsible for keeping your billing information current. Failure to pay may result in suspension of service.
There is no long-term contract. You may cancel at any time by contacting us at the email below. Cancellation stops future recurring charges and takes effect at the end of your current billing period. Unless stated otherwise at the time of purchase, setup fees and amounts already billed are non-refundable.
By requesting a demo or callback, you consent to an automated AI voice call and related text messages at the number you provide, as described in our Privacy Policy. The voice on a demo call is an AI, not a person, and the call may be recorded. Consent is not a condition of purchase, and you may opt out at any time (tell the agent to stop, reply STOP to a text, or email us).
Our services use artificial intelligence. By using AI-powered features you acknowledge that: • You may be interacting with an automated system rather than a person; we disclose when you are talking to an AI, and you can request human follow-up. • AI-generated responses are produced algorithmically and may occasionally be inaccurate or incomplete. You are responsible for reviewing AI-generated content before relying on it. It is not legal, financial, medical, or other professional advice. • You may not use our AI features to break the law, harass others, impersonate people without consent, create misleading synthetic media without disclosure, attempt to extract our models or training data, or build a competing product.
You agree to use the services lawfully and not to: violate any law or third-party right; send spam or unsolicited communications; upload malware; interfere with or disrupt the services; attempt unauthorized access; scrape or harvest data without consent; or reverse engineer the services. You are responsible for ensuring that the phone numbers, business details, and customer communications you enroll comply with all applicable laws.
The site and its content, features, and functionality are owned by Spark Road AI or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the services for your business in accordance with these Terms. You retain rights to the content and data you provide to us. You may not copy, modify, distribute, sell, or create derivative works from our content except as expressly permitted.
Our services rely on third-party platforms, including GoHighLevel / LeadConnector, Retell AI, Twilio, Stripe, and Cloudflare. These platforms are operated by their respective providers, and their availability and features are outside our control. We are not responsible for outages, data loss, security incidents, or changes originating from these third-party platforms, and your use of services that depend on them is subject to their terms.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the services will be uninterrupted, error-free, or secure, or that they will produce any specific lead volume, revenue, or business result.
TO THE FULLEST EXTENT PERMITTED BY LAW, SPARK ROAD AI AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100).
You agree to indemnify and hold harmless Spark Road AI and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the services, or your violation of any law or third-party right.
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the services will be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association under its Commercial Arbitration Rules in Wisconsin. You waive the right to a jury trial and to participate in a class action. Any claim must be brought within one (1) year after it arises.
Our SMS program sends messages such as appointment reminders, confirmations, the secure payment link, service updates, and occasional promotional messages you opt into. Message frequency varies. Text STOP at any time to cancel; we will send one confirmation and then stop. Text HELP for help, or email us. Message and data rates may apply. By opting in you authorize us to send recurring messages to the number you provide; you are not required to opt in as a condition of any purchase. Carriers are not liable for delayed or undelivered messages. Our messages will never include phishing or prohibited (SHAFT) content.
We may update these Terms from time to time. We will post the updated version here with a new "last updated" date. Your continued use of the services after changes are posted constitutes acceptance of the updated Terms.
